Spa City Softwash — Service Agreement & Terms of Service

By requesting an estimate, approving a quote, scheduling service, or allowing work to begin, you (“Customer”) agree to the following Terms of Service with Spa City Softwash (“Company,” “we,” “our,” or “us”).

1. Professional Cleaning Philosophy

Spa City Softwash focuses on safe, professional exterior cleaning — not aggressive restoration.

Our goal is to remove organic buildup while protecting your home’s materials, finishes, and long-term condition.

We do not use excessive pressure or risky methods simply to chase cosmetic perfection.

2. Scope of Service

Services may include:

  • Soft washing (house washing)

  • Exterior maintenance services

  • Bug and web removal

  • Maintenance plan visits

  • Exterior surface cleaning

  • Fence Washing

  • Deck Washing

  • Furniture Washing

  • Concrete Cleaning

Not all stains or discoloration are removable through exterior cleaning. Approval of service acknowledges acceptance of these limitations.

3. Pricing & Estimate Accuracy

Estimates are based on the information available at the time of quoting.

Final pricing may change if:

  • Square footage differs from provided details

  • Access or safety conditions differ

  • Siding material differs from vinyl

  • Organic buildup is significantly heavier than expected

We reserve the right to pause work and revise pricing if scope changes.

4. Oxidation Disclosure & Customer Acceptance

Oxidation is a natural aging process of siding and is not dirt.

Customers acknowledge that:

  • Cleaning may reveal oxidation that was previously hidden

  • Water contact may temporarily create visible lines or streaking

  • No exterior cleaning service restores oxidized siding

We will not be responsible for:

  • Uneven appearance caused by oxidation

  • Chalky residue changes

  • Color fading revealed after cleaning

Attempting to aggressively remove oxidation risks permanent damage — which we will not perform.

5. Artillery Fungus Policy

Artillery fungus is a hardened spore that cannot be safely removed through standard house washing.

Customers acknowledge:

  • Artillery fungus will remain after cleaning

  • Manual removal is not included and is not recommended

  • Pressure washing or aggressive scrubbing may permanently damage siding

Spa City Softwash is not responsible for artillery fungus visibility after washing.

6. Results Expectations

Our service removes:

  • Algae

  • Mold

  • Mildew

  • Organic growth

  • Dirt and environmental buildup

Our service does not remove:

  • Oxidation

  • Paint

  • Rust

  • Oil or grease stains

  • Permanent discoloration

  • Artillery fungus

  • Structural damage

Approval of service confirms acceptance of these limitations.

7. Weather & Scheduling

Exterior cleaning is weather-dependent.

We may reschedule due to:

  • Freezing or near-freezing temperatures

  • High winds

  • Severe storms

  • Unsafe working conditions

Rain alone typically does not cancel service.

8. Customer Responsibilities

Before service, customers agree to:

  • Close all windows and doors

  • Secure pets

  • Provide exterior access

  • Move vehicles and loose items away from the home

  • Provide water access if discussed

Failure to prepare may result in rescheduling or additional fees.

9. Landscaping & Plant Protection

We take professional precautions including:

  • Pre-wetting landscaping

  • Controlled application

  • Post-rinsing

However, customers acknowledge:

  • Cleaning solutions are used

  • Pre-existing plant stress may increase risk

  • Newly planted or delicate plants must be disclosed beforehand

Spa City Softwash is not liable for damage to unhealthy or undisclosed sensitive vegetation.

10. Property Condition Disclosure

The Company is not responsible for damage resulting from pre-existing conditions including:

  • Loose siding or trim

  • Oxidized surfaces

  • Failing paint

  • Cracked seals or windows

  • Improper construction

  • Hidden structural issues

Cleaning may reveal conditions that were previously hidden by buildup.

11. Maintenance Plan Terms

Maintenance plans are proactive services designed to maintain cleanliness.

Important notes:

  • Rinse services are not standalone visits

  • Maintenance visits are lighter in scope than a full soft wash

  • Scheduling is weather-dependent

12. Payment Terms

Payment is due upon completion unless otherwise agreed.

Failure to pay may result in:

  • Late fees

  • Collection actions

  • Suspension of future service

13. Media Use

We may photograph or record exterior work areas for:

  • Documentation

  • Training

  • Marketing

No personal identifying information will be shared without consent.

14. Limitation of Liability

To the fullest extent permitted under New York law:

  • Liability is limited to the value of the service performed.

  • We are not responsible for indirect or consequential damages.

  • Exterior cleaning carries inherent risk which the customer accepts.

15. Dispute Resolution

These Terms are governed by the laws of New York State.

Any disputes shall be handled within Saratoga County, New York.

16. Acceptance of Terms

Approval of service, verbal authorization, or allowing work to begin constitutes acceptance of this agreement.
